FIA acts on potential budget cap loophole

NEWS STORY
21/10/2026

Having clearly been reading Max Nobles's warnings from a couple of years back, the FIA is taking drastic action to close potential loopholes in the budget cap regulations.

In essence, the raft of draconian new rules are aimed at preventing non-F1 staff working on F1 projects, whereby their cost might not be included in what the team declares when it submits its spending to the authorities.

With some teams involved in WEC, Formula E and even Cycling and Sailing such things are possible, indeed with Red Bull, Mercedes and Aston Martin having established the likes of Advanced Technologies, Applied Science and Performance Technologies such things may have even been considered. Why, Ferrari has its Hypersail yacht and it was only last year that McLaren sold its Applied Science to a private investment group.

While there is no proof of any such goings on, almost from the day the cost cap was introduced there has been speculation, with Max Noble leading the way in terms of how such 'creativeness' might be applied.

How draconian are the new rules? Well, non-F1 staff are now banned from entering the F1 factory, while F1 staff are similarly banned from their team's non-F1 facilities and a non-F1 staff member who switches to the F1 programme will have to undergo three months gardening leave.

Here are the regulations in full... and yes, we will be asking questions later.

Article F6: Physical and IT Segregation between F1 Activities and Non-F1 Activities.

F6.1 General Principles

F6.1.1 Subject to the provision of this Article F6:

a. Restricted F1 Workforce are not permitted to access at any point in time the Restricted Non-F1 Area or to access IT Outputs generated by Restricted Non-F1 Workforce

b. Restricted Non-F1 Workforce are not permitted to access at any point in time the Restricted F1 Area or to access IT Outputs generated by Restricted F1 Workforce.

In order to ensure the segregation between Restricted F1 Workforce and Restricted Non-F1 Workforce is effected and maintained, all Entities Subject To Segregation Requirements must comply with the requirements set out in this Article F6 throughout the entirety of each Financial Regulations Reporting Period.

F6.1.2 The FIA is entitled to verify from time to time that each Entity Subject to Segregation Requirements complies with the requirements set out in this Article F6, including through (i) physical inspections of facilities where F1 Activities and/or Non-F1 Activities are undertaken and/or (ii) IT forensic audit procedures and controls. F1 Teams must cooperate (and must procure that the other Entities Subject to Segregation Requirements within their respective Legal Group cooperate), with the FIA during such inspections and controls.

F6.1.3 The F1 Teams must comply (and must procure that the other Entities Subject To Segregation Requirements within their respective Legal Group comply) with the provisions of Article F6 in Good Faith, acting at all times with honesty and integrity, and in a spirit of transparency and cooperation.

F6.1.4 The F1 Teams must not take any steps to circumvent the requirements set out in this Article F6 and/or the IT Segregation Objective. In particular, Entities Subject to Segregation Requirements shall not (and shall ensure that members of its Workforce do not)

1) use communication or messaging systems, whether internal or external; or
2) access IT Output and/or copy or download IT Output to any external drive; or
3) use any Permitted Transfer; or
4) use movement and/or redeployment of members of the Workforce ; or
5) enter into contractual arrangement with services providers; or
6) exchange, disclose, solicit or receive any information, data, know-how or IT Output relating to F1 Activities or Non-F1 Activities; or
7) use any member of the Non-Restricted Workforce or any third party as an intermediary or conduit in such a way that has the object or the effect of circumventing the requirements set out in Article 0 and Article 0 and/or the IT Segregation Objective and/or the Physical Segregation Objective.

F6.2 Physical segregation requirements

F6.2.1 The objective of this Article 0 is to prevent members of the Restricted F1 Workforce and Restricted Non-F1 Workforce from sharing any physical working space in the facilities used by the Entities Subject to Segregation Requirements ("Physical Segregation Objective").

F6.2.1 Subject to Article 0 and Article F6.2.7, members of the Restricted Non-F1 Workforce shall render their services from a location ("Restricted Non-F1 Area") that is physically segregated from the location used by Restricted F1 Workforce ("Restricted F1 Area"). Members of the Restricted F1 Workforce are prevented from accessing at any point in time during the Financial Regulations Reporting Period the Restricted Non-F1 Area.

F6.2.3 Subject to Article 0 and Article F6.2.7, members of the Restricted F1 Workforce shall render their services from the Restricted F1 Area that is physically segregated from the Restricted Non-F1 Area. Members of the Restricted Non-F1 Workforce are prevented from accessing at any point in time during the Financial Regulations Reporting Period the Restricted F1 Area.

F6.2.4 Members of the Non-Restricted Workforce may render their services from either the Restricted F1 Area or Restricted Non-F1 Area (or a combination of the two).

F6.2.5 Provided they are used exclusively for their primary purpose throughout the Financial Regulations Reporting Period, the following areas within facilities used by Entities Subject To Segregation Requirements, may be accessed and used by members of the Restricted Non-F1 Workforce and the Restricted F1 Workforce although never at the same time:

a. area hosting Wind Tunnel;
b. area hosting Driver-in-the-loop simulators;
c. area hosting Dynamometers;
d. area hosting Test Benches and rigs;
e. "Data Centres";

g. any other area as may be determined and communicated by the Cost Cap Administration via a Determination from time to time.

The areas that satisfy the requirements set out in this Article 0 are collectively defined as the "Restricted Shared Area"

F6.2.6 When used by members of the Restricted F1 Workforce the Restricted Shared Area shall be considered to be Restricted F1 Areas and until such time as the members of the Restricted F1 Workforce have ceased to use and occupy such Restricted Shared Areas, such Restricted Shared Areas shall not be accessible to members of the Restricted Non-F1 Workforce. When used by members of the Restricted Non-F1 Workforce the Restricted Shared Area shall be considered to be Restricted Non-F1 Areas and until such time as the member of the Restricted Non-F1 Workforce have ceased to use and occupy such Restricted Shared Areas, such Restricted Shared Areas shall not be accessible to members of the Restricted F1 Workforce.

F6.2.7 Notwithstanding Articles 0, 0 and 0, an Entity Subject to Segregation Requirements may designate members of Restricted F1 Workforce as "Approved Operational Support Personnel". The Approved Operational Support Personnel:

a. may access the Restricted Shared Area whilst it is used by members of the Restricted Non-F1 Workforce solely and exclusively for the purpose of Non-F1 Activities operational support, safety supervision, compliance verification or facility management of the equipment and/or infrastructure normally hosted within that Restricted Shared Area. This access is permitted only for activities that cannot be performed by the Restricted Non-F1 Workforce themselves and that cannot be delayed until a time when the Restricted Non-F1 Workforce have vacated the Restricted Shared Area. The access shall last for the minimum time necessary to undertake the support task.

b. must not undertake any F1 Activities whilst the Restricted Shared Area is being used by members of the Restricted Non-F1 Workforce;

c. must not cause, whether directly or indirectly, IT Output, any kind of data, information, know-how, technical configuration or test methodology generated by the Restricted Non-F1 Workforce to be transferred to, used in, influence, inform or contribute to any F1 Activities, except to the extent strictly necessary to ensure the safe, reliable and compliant operation, of the Restricted Shared Area facilities;

d. must not observe, access, query or participate in Non-F1 Activities, its work product, data, configurations or methodologies beyond what is strictly necessary to carry out those activities allowed under a.
