The family of three-time World Champion Jack Brabham has taken legal advice after learning that a German businessman has submitted an entry for the 2010 season under the name of Brabham Grand Prix.

Writing on his website, David Brabham, son of the illustrious Australian racer said: "The family would like to make it clear that they are in no way involved with Brabham Grand Prix Limited and received no consultation regarding the company's plans to resurrect their historic name in Formula One.

"The family is taking legal advice and will take necessary steps to protect their name, reputation and its goodwill."

The man behind the Brabham Grand Prix bid is Franz Hilmer of Formtech GmbH, the company that bought the assets Super Aguri late last year.

Brabham, which was founded in 1961, remains the only team to win the F1 World Championship with a driver bearing the same name, Jack taking the 1966 crown and subsequently coming close to repeating the feat in 1970.

The team was sold to Bernie Ecclestone in 1972, the Englishman taking the title with Nelson Piquet before selling it on to the Japanese Middlebridge group.

Damon Hill made his debut with the team in 1992, its last season in F1.
