Rubython apologises for Whiting allegation

The following statement was read in Court 14 of the High Court this morning before Mr. Justice Gray:

Counsel for the Claimant: In this action Mr Whiting complains that in the October 2005 edition of Business F1 magazine, of which Mr Rubython was the Editor-in-Chief, Mr Rubython wrote articles which alleged that in 1994 Mr. Whiting falsified the crash test results of the Simtek S941 Formula One car chassis, that he thereby endangered the lives of the drivers who went on to drive Simtek cars and that he contributed to the death of Roland Ratzenberger and put Andrea Monterinini's life at risk when they competed in grand prix races later that year using Simtek cars.

My Lord, these allegations are untrue and there was no basis for making them. Mr Rubython, who has not pleaded a defence of justification, appears before you today to apologise unreservedly for making them and to retract them. He has also given an undertaking never to repeat them.

Solicitor for the Defendant: My Lord, on behalf of Mr Rubython, I wish to associate myself with all that has been said by counsel for the Claimant. Mr Rubython is grateful for this opportunity to apologise publicly to Mr Whiting for making the allegations complained of, to retract them and also to apologise for the distress he has caused to Mr Whiting.
