Force India boss Vijay Mallya has said that unless he is formally charged with assault he is not considering taking action against Adrian Sutil.

The Force India boss was asked at today's FIA press conference whether Sutil's future with the team is in danger following an incident in a Shanghai nightclub on the night of the Chinese Grand Prix. Eric Lux, chief executive of Renault F1 team owners Genii Capital subsequently filed a criminal complaint for physical assault and grievous bodily harm.

"I'm not willing to jump to any conclusions, based on a press release that has been given out by a potentially or supposedly aggrieved party," said Mallya. "I don't know what happened there, none of my people know what happened at that particular incident so there's a due process of law.

"So if Adrian is to be charged with misconduct, let him be charged," he added. "If and when he's charged, I will assess the situation."
